TERMS OF SERVICE

OVERVIEW

Welcome to Brick Bar. The terms “we,” “us” and “our” refer to Brick Bar LLC. Brick Bar operates this store and website, including the related information, content, features, tools, products and services provided to customers (collectively, the “Services”). Brick Bar is powered by Shopify, which enables us to provide the Services.

These Terms of Service, together with the policies referenced below (collectively, the “Terms”), describe your rights and responsibilities when using the Services.

Please read these Terms carefully. They contain important information concerning your legal rights, including warranty disclaimers and limitations of liability.

By visiting, interacting with or using the Services, you agree to these Terms and our Privacy Policy, available at https://brickbar.shop/policies/privacy-policy. If you do not agree, you should not access or use the Services.

SECTION 1 — ACCESS AND ACCOUNTS

By agreeing to these Terms, you represent that you are at least the age of majority in your state of residence or that you are using the Services with the permission and supervision of a parent or legal guardian.

To use certain Services or purchase products, you may be asked to provide information such as your email address and billing, payment and shipping information. You represent that the information you provide is accurate, current and complete and that you have the right to provide it.

You are responsible for safeguarding your account credentials and for activity conducted through your account. You may not transfer, sell, assign or license your account to another person.

SECTION 2 — OUR PRODUCTS

We make reasonable efforts to describe and represent our products accurately. Colors and appearance may vary depending on your device, display settings and lighting conditions.

Many products sold by Brick Bar are genuine pre-owned LEGO® elements or minifigures. Pre-owned products may show minor signs of normal prior use. Product descriptions will identify any known material defects or missing components when applicable.

Photographs of individually listed minifigures and other individually identified used products are intended to depict the item being offered. Photographs of Brick Bar Extras, Brick Boxes and other assorted products are representative. The exact pieces, colors and contents of assorted products may vary unless otherwise stated.

We do not guarantee that a product’s appearance or perceived quality will exactly match its on-screen appearance or a customer’s subjective expectations.

Product descriptions, availability and pricing may change without notice. We may discontinue products or limit quantities offered to any person, geographic area or jurisdiction.

LEGO® is a trademark of the LEGO Group of companies, which does not sponsor, authorize or endorse Brick Bar or this website.

SECTION 3 — ORDERS

Submitting an order constitutes an offer to purchase. Brick Bar may accept, decline, limit or cancel an order for legitimate business reasons, including product unavailability, suspected fraud, pricing errors or violations of these Terms.

An order is not accepted until payment has been authorized and Brick Bar confirms the order. Please review your order carefully before submitting it because we may be unable to accommodate cancellation or modification requests after processing begins.

If we decline, modify or cancel an order, we will attempt to notify you using the email address, billing address or telephone number provided with the order. If payment has already been collected for a canceled item, the applicable amount will be refunded.

SECTION 4 — PRICES AND BILLING

Prices, discounts and promotions may change without notice. The price charged will be the price displayed when the order is submitted, subject to correction of obvious errors.

Unless otherwise stated, displayed prices do not include applicable taxes or shipping charges. Those amounts will be calculated and displayed during checkout.

Prices offered through the website may differ from prices offered through other sales channels or at future physical retail locations. Promotions may be subject to separate terms. If promotional terms conflict with these Terms, the promotional terms control for that promotion.

You agree to provide accurate and current purchase, payment and account information. You represent that you are authorized to use the payment method submitted and agree to pay all charges associated with your order, including applicable taxes and shipping charges.

SECTION 5 — SHIPPING AND DELIVERY

Order processing, shipping charges, delivery estimates, tracking and related matters are governed by our Shipping Policy, available at https://brickbar.shop/policies/shipping-policy.

Delivery dates are estimates and are not guaranteed. Brick Bar is not responsible for delays caused by carriers, weather, service interruptions, incorrect addresses or other circumstances beyond our reasonable control.

Nothing in these Terms limits any rights or remedies that cannot lawfully be waived.

SECTION 6 — INTELLECTUAL PROPERTY

The Services—including Brick Bar’s original trademarks, branding, text, graphics, photographs, videos, audio, website design and selection and arrangement of content—are owned by Brick Bar LLC or used with permission and are protected by applicable intellectual-property laws.

These Terms permit you to use the Services for personal, noncommercial purposes. Without our prior written consent, you may not reproduce, distribute, modify, create derivative works from, publicly display, republish, download, store or transmit material from the Services, except as permitted by applicable law.

Nothing in these Terms grants you a license or ownership interest in any intellectual property belonging to Brick Bar, Shopify, the LEGO Group or another party.

The Brick Bar and Brick Bar Extras names, logos, designs and slogans are trademarks claimed by Brick Bar LLC. Shopify’s names and marks belong to Shopify. LEGO® and associated marks belong to the LEGO Group. Other names and marks appearing through the Services belong to their respective owners.

SECTION 7 — OPTIONAL TOOLS

The Services may provide access to tools operated by third parties that we do not control or monitor.

Unless otherwise expressly stated, access to third-party tools is provided “as is” and “as available,” without warranties, representations or endorsements by Brick Bar. Your use of such tools is at your own risk and is subject to the applicable third party’s terms and policies.

We may introduce new features, tools or resources. Unless otherwise stated, those additions are part of the Services and are subject to these Terms.

SECTION 8 — THIRD-PARTY LINKS

The Services may contain links to third-party websites or embedded third-party functionality. Brick Bar is not responsible for evaluating or guaranteeing the content, accuracy, availability, security or practices of third-party services.

If you access a third-party service, you do so at your own risk. Review the third party’s terms and policies before providing information or completing a transaction. Questions or disputes concerning third-party products or services should be directed to the applicable third party.

SECTION 9 — RELATIONSHIP WITH SHOPIFY

Brick Bar is powered by Shopify, which enables us to provide the Services. However, purchases made through our store are transactions directly between you and Brick Bar.

By using the Services, you acknowledge that Shopify is not responsible for sales between you and Brick Bar, including injury, damage or loss resulting from products purchased from Brick Bar. To the fullest extent permitted by law, you release Shopify and its affiliates from claims, damages and liabilities arising from or relating to your purchases and transactions with Brick Bar.

SECTION 10 — PRIVACY

Personal information collected through the Services is governed by our Privacy Policy, available at https://brickbar.shop/policies/privacy-policy.

Because Shopify hosts the Services, Shopify collects and processes certain personal information concerning access to and use of the Services. Information submitted through the Services may be transmitted to Shopify and other service providers, which may process information in countries other than your country of residence.

Shopify’s handling of personal information is also governed by Shopify’s applicable privacy policies. Please review our Privacy Policy for more information about how Brick Bar, Shopify and our service providers collect, use and share information.

SECTION 11 — FEEDBACK

If you voluntarily submit ideas, suggestions, reviews, photographs, comments or other content to us (“Feedback”), you grant Brick Bar a nonexclusive, perpetual, worldwide, sublicensable and royalty-free license to use, reproduce, modify, publish, distribute and display that Feedback for purposes related to operating, improving and promoting the Services.

You represent that you own or possess the rights necessary to submit the Feedback, that you have disclosed any compensation or incentive associated with it, and that the Feedback does not violate applicable law or another person’s intellectual-property, privacy or other rights.

We are not required to keep Feedback confidential, pay compensation for it or respond to it. We may remove Feedback that we reasonably determine is unlawful, misleading, abusive, obscene, defamatory, infringing or otherwise objectionable.

You may not submit Feedback containing malicious code, use a false identity or misrepresent the origin of the Feedback. You remain responsible for the Feedback you submit and its accuracy.

SECTION 12 — ERRORS, INACCURACIES AND OMISSIONS

Information provided through the Services may occasionally contain typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, availability, shipping charges or estimated delivery times.

We may correct errors, update information or cancel an affected order at any time, including after submission. If we cancel an order after collecting payment, we will refund the applicable amount.

SECTION 13 — PROHIBITED USES

You may use the Services only for lawful purposes. You may not use the Services:

(a) for an unlawful, fraudulent or malicious purpose;

(b) to violate applicable laws or regulations;

(c) to infringe Brick Bar’s rights or the rights of another party;

(d) to harass, abuse, threaten, defame or harm another person;

(e) to submit false or misleading information;

(f) to transmit material that violates these Terms;

(g) to distribute spam, phishing messages, malware or unauthorized advertising;

(h) to impersonate another person or entity;

(i) to collect or track personal information without authorization;

(j) to interfere with the operation or security of the Services; or

(k) to circumvent access controls, robot-exclusion measures or other technical restrictions.

You also may not reproduce, duplicate, copy, extract, sell, resell or exploit the Services or their contents except as expressly authorized by Brick Bar.

Automated tools and agents may access the Services only as expressly permitted by Section 14. We may suspend or terminate access if we reasonably determine that these Terms have been violated.

SECTION 14 — AUTOMATED AGENTS

This section applies when a person uses, enables or directs software that acts autonomously or semi-autonomously on the person’s behalf to access or interact with the Services (an “Agent”).

An Agent may access or interact with the Services only when it truthfully identifies itself and complies with these Terms, applicable law and any technical instructions or restrictions communicated by Brick Bar.

Agents must not conceal their automated nature, impersonate human users, circumvent CAPTCHAs or other safeguards, interfere with the Services, evade access limitations or continue accessing the Services after Brick Bar has requested that access stop.

We may use technical measures to limit or control Agent access to protect customers, inventory, security and the operation of the Services.

SECTION 15 — TERMINATION

We may suspend or terminate access to the Services when reasonably necessary to protect Brick Bar, its customers, Shopify or other parties; enforce these Terms; prevent fraud or misuse; or comply with legal obligations.

You remain responsible for amounts incurred before termination.

Provisions that by their nature should survive termination—including those concerning intellectual property, privacy, disclaimers, limitations of liability, indemnification, governing law and dispute resolution—will remain effective.

SECTION 16 — DISCLAIMER OF WARRANTIES

Information presented through the Services is provided for general informational purposes. Although we make reasonable efforts to provide accurate information, we do not warrant that all information will always be complete, current or error-free.

TO THE FULLEST EXTENT PERMITTED BY LAW, AND EXCEPT AS EXPRESSLY PROVIDED IN THESE TERMS OR AN APPLICABLE WRITTEN POLICY, THE SERVICES AND PRODUCTS OFFERED THROUGH THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT EXPRESS OR IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT ACCESS TO THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE.

SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY DISCLAIMERS. IN THOSE JURISDICTIONS, THESE DISCLAIMERS APPLY ONLY TO THE EXTENT PERMITTED BY LAW.

SECTION 17 — LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, BRICK BAR LLC AND ITS OWNERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS AND LICENSORS, AND SHOPIFY AND ITS AFFILIATES, WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA OR REPLACEMENT COSTS, ARISING FROM OR RELATING TO THE SERVICES OR PRODUCTS PURCHASED THROUGH THE SERVICES.

THIS LIMITATION APPLIES REGARDLESS OF THE LEGAL THEORY ASSERTED AND EVEN IF THE POSSIBILITY OF SUCH DAMAGES WAS DISCLOSED.

NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED.

SECTION 18 — INDEMNIFICATION

To the extent permitted by law, you agree to indemnify, defend and hold harmless Brick Bar LLC, Shopify and their respective affiliates, owners, officers, directors, employees, agents, contractors, licensors and service providers from third-party claims, damages, liabilities and reasonable legal expenses arising from:

(a) your material breach of these Terms;

(b) your violation of applicable law or another party’s rights; or

(c) your fraudulent, malicious or unauthorized use of the Services.

We will provide reasonable notice of an indemnifiable claim. Failure to provide prompt notice will relieve you of your obligations only to the extent you are materially prejudiced. You agree to provide reasonable cooperation in the defense of the claim.

SECTION 19 — SEVERABILITY

If a provision of these Terms is determined to be unlawful, void or unenforceable, that provision will be enforced to the fullest extent permitted by law or severed to the minimum extent necessary. The remaining provisions will continue in effect.

SECTION 20 — WAIVER AND ENTIRE AGREEMENT

Our failure to enforce a provision of these Terms does not waive our right to enforce it later.

These Terms and the policies incorporated by reference constitute the entire agreement between you and Brick Bar concerning the Services and supersede prior communications or agreements concerning the same subject matter.

Any ambiguities will not automatically be construed against the party that drafted these Terms.

SECTION 21 — ASSIGNMENT

You may not transfer or assign these Terms or your rights or obligations under them without our prior written consent.

We may transfer or assign these Terms and our related rights and obligations in connection with a merger, reorganization, sale of assets, change of control or other legitimate business transaction.

SECTION 22 — GOVERNING LAW AND VENUE

These Terms and any dispute arising from or relating to the Services will be governed by the laws of the State of Alabama, without regard to its conflict-of-laws principles.

Subject to any rights that cannot lawfully be waived, you and Brick Bar consent to the jurisdiction and venue of the state and federal courts located in Jefferson County, Alabama.

Section headings are included for convenience and do not limit or affect the interpretation of these Terms.

SECTION 24 — CHANGES TO THESE TERMS

The current version of these Terms is available on this page.

We may update these Terms by posting a revised version through the Services. Material changes will be communicated as required by applicable law and will become effective on the date stated in the notice or revised Terms.

Your continued use of the Services after revised Terms become effective constitutes acceptance of those revisions.
